Novogradac Article "OBBBA and the Clean Energy Race Against the Clock"

The One Big Beautiful Bill Act (OBBBA) has had far-reaching ramifications for Clean Energy. Clean Energy Technologies specifically have been prohibited from transferring energy credits to specified foreign entities (SFEs) under the new FEOC restrictions. Early sunset dates for Clean Energy incentives have been set for automobiles, homes, and commercial buildings. Solar and wind facilities must be placed in service by December 31, 2027, to qualify for the investment and production tax credits, but projects beginning construction by July 4, 2026, can still qualify if they are in service by the end of the calendar year four (4) years later. The 5% safe harbor for solar projects is only available for low-output solar facilities. Other eligibility and strategic timelines are outlined. FEOC compliance challenges are up ahead. The next three years will be crucial to Clean Energy's survival.
